INTRODUCTION: The tenant and his companions expressly accept, and without reservation the following conditions of contract. The contractual relationship will be formalized directly between the tenant and the owner of the property.
THE FINAL PRICE INCLUDES: Accommodation in the housing for the contracted period, VAT and other applicable taxes, administration costs, domestic appliances, kitchen utensils, tableware etc.
PRICES OF THE OPTIONAL AND MANDATORY SERVICES: These services vary according to the renting and their amounts vary according to the duration of the stay or the number of people staying in the house. These amounts are shown on our website on the reservation form. Some of these services are free of charges.
HOW TO BOOK: To confirm your pre-reservation you will have to pay an advance of the final amount of the booking. The amount of this deposit will be specified in the property’s description and could change depending on the housing, the season and the selected services. After 24/48 hours you will receive an email confirming your pre-reservation. The remaining amount, date and forms of payment are specified in each property’s page and the pre-reservation email. Once your booking is confirmed by the agency you will receive an email within 24/48h confirming your booking and giving you the contact information of the agency for the collection of the keys.
CANCELLING OR MODIFICATION OF THE BOOKING BY THE AGENCY: We reserve ourselves the right to cancel the booking in case of not receiving the different payments (or their justification) at the indicated dates. In case a serious incident would occur in the house, preventing its renting, The Agency will do its possible to offer an alternative house with similar or superior characteristics and for the same price. If there wasn’t any possible alternative or if the client was to refuse this alternative, The Agency will refund the amounts already paid.
CANCELLATION AND MODIFICATION OF THE BOOKING BY THE CLIENT: The cancellation or modification of your booking must be reported as soon as possible at the e-mail address or fax number indicated in the reservation receipt. The cancelation will result in the following penalties according to its anticipation:
More than 8 weeks before the arrival date: 10% of the total amount of the rent. Between 4 and 8 weeks before the arrival date: 50% of the total amount of the rent. Between 1 and 4 weeks before the arrival date: 90% of the total amount of the rent. Less than 1 week before the arrival date: 100% of the total amount of the rent
DESCRIPTIONS, PHOTOS AND SERVICES DISPLAYED: We are striving to offer you the best information possible. The pictures and descriptions displayed are frequently revised. Nevertheless it is possible that variations occur regarding the furniture or the interior that are displayed. Likewise, certain services such as swimming pools, saunas, sports facilities, restaurants may temporarily be off service due to the season or to repairs. These changes won’t give right neither to compensation nor claims.
DELIVERY OF THE KEYS: The delivery of the keys will be carried out at the address and date indicated in your reservation form. In high season the delivery of the keys normally takes place between 05:00 P.M and 07:00 P.M on the date of entry. In case of an arrival outside those hours or on a local public holiday, you need to contact the agency indicated in your reservation form to coordinate the keys’ delivery. Failure to do so may result in the impossibility for you to occupy the housing the day of your arrival. Arrival off the clock (between 07:00 P.M and midnight) will result in a supplement of 50 €. IMPORTANT NOTE: After midnight, The Agency agency will be closed and won’t be able to attend to you until the following day at 10:00 A.M
PAYMENT OF THE DEPOSIT: The payment of a deposit guarantees the good use and conversation of the furniture, and the conditions of use of the contracted accommodation. In case there aren’t any damages in the house, said deposit will be entirely repaid to you within 72 hours following your departure and the final cleaning and check of the house. The tenant must leave the house in the same state he has found it at his arrival, clean, tidy and without accumulated waste. Failure to respect this will result in a penalization amounting to part or, in the most serious cases, in the totality of the deposit.
DEFICENCIES: The client must indicate to the agency any deficiencies in the house within 6 hours after check-in. Past this deadline, any deficiencies will be considered as of the responsibility of the client. The Agency will try to solve the problem as soon as possible.
BREAKDOWNS: The agency will take care of the problem as quickly as possible. In case household electrical equipment would stop working or a dysfunction occurs in the installations of water, light, gas or other services the tenant will have to inform The Agency, which in turn will notify the technical department to solve the problem as soon as possible.
RESPONSIBILITIES: The number of people staying in the contracted accommodation may not exceed the indicated capacity of the house, except in the case of infants (children of less than 2 years of age). The Agency can require the full names, I.Ds or passports, of each person staying in the accommodation (older than 16 years). The Agency can refuse the entrance to any unauthorized person and won’t accept any complaint on this matter. Likewise, pets are authorized only if expressly indicated in the property’s description form. The presence of a pet may result in a supplement (see each property’s description form). It is formally forbidden to the tenant to modify the initial configuration of the house’s furniture. The tenant undertakes to keep the housing clean, tidy and in the same state he has entered it. He also undertakes to follow the instructions of maintenance and of use we shall transmit him, and to respect the regulations regarding noises, waste collection, water consumption. Failure to respect those rules will allow The Agency to require an eviction of the accommodation without any compensation, a financial compensation for the damage and the inconveniences caused by the tenant, as well as the non-repayment of the deposit.
PROHIBITIONS : It is formally forbidden to use the accommodation as commercial premises, warehouse or as an office; for the shooting of movies, commercials, reports or any other type of non-authorized shooting ; the detention of flammable, explosive or unhygienic materials; the subletting or the total or partial transfer of the accommodation whether for free or for a fee ; the placement on the windows or balconies of announcements, placards or other elements which would alter or modify the uniformity or the esthetics of the accommodation; the installation of engines or machines.
CHECK OUT: Departures will have to be made before 10:00 A.M. The tenant will have to contact the agency 2 days before his departure to communicate his rough hour of departure. In case the tenant would like to leave before the fixed hour or day, he needs to inform The Agency. The deposit will be repaid by bank transfer within 72 hours following his departure, once the impeccable state of the house has been verified. In case the tenant would like to leave the house later, he will have to inform The Agency to discuss the possibility of extending his stay for a few hours, for an additional cost. If this isn`t possible, it is also possible to discuss the possibility of leaving his luggage at the agency, within the opening hours and under his responsibility.
DEVOLUTION OF THE KEYS: At the end of the lease, the tenant must vacate the property and return the keys on the same day, so as to leave it available to The Agency and the owner. Failure to do so will oblige The Agency to keep the deposit and to charge the tenant with the costs caused by the breach and, by way of penalty, an amount equal to five tomes the contract price for each period of time, until the owner recovers his property.
RELEASE OF LIABILITY: The Agency will not be liable for the following cases (indicated as a purely illustrative purpose and in a non-limiting character): Inferences, omissions, interruptions, computer viruses, defaults and disconnections in the functioning of the reservation system, which would prevent or delay the navigation of the system. The lack of availability, accuracy, currency, maintenance and effective operation of the website and/or its services or contents. In any case, for any liability that may occur, compensation will never exceed 50% of the booking amount.
PRIVACY: The personal data provided by the tenant on the booking form will be included in a file whose ownership belongs to The Agency. The purpose of the collection and processing of this information is the administration of the requested service, the maintenance of the commercial relationship, as well as to keep the tenant informed of our new services and offers. In compliance with current regulations, The Agency warrants that it has taken the necessary measures and techniques to maintain the level of security required by the nature of the personal data We also inform you that you may exercise your rights of access, rectification, cancellation and opposition regarding their personal data by writing to us and sending a copy of an I.D to the address indicated on the reservation voucher. The Agency will not give or communicate data stored in its files to others, except in those cases where such communication is authorized by the user, required by law or is necessary for the provision of the requested service.
LAW AND JURISDICTION: In all matters not provided for in these conditions shall apply in any case, the Spanish laws and regional regulations. The parties, expressly waiving any other jurisdiction that may correspond Act , submit to the jurisdiction of the courts of the city of Denia to resolve any issues arising from the application and interpretation of this contract.
